Terms of Service

These terms govern your use of cutz, an AI video editor you use over WhatsApp, our website at cutz.si and our web app at app.cutz.si (together, the “Services”). cutz is a product of HireCreatives (“HireCreatives”, “we”, “us”). By using the Services, you agree to these terms and to our Privacy Policy.

1. Who may use cutz

You must be at least 16 years old to use the Services. If you use cutz on behalf of a business or another person, you confirm that you are allowed to accept these terms for them.

2. Your account

Your account is tied to your WhatsApp phone number. You are responsible for everything done through your number and your sign-in to app.cutz.si. Tell us at once at privacy@cutz.si if you believe someone else is using your account.

3. How cutz works

You send cutz videos, files, links and instructions (“Input”). cutz uses artificial intelligence to produce edited videos and replies (“Output”). Typical times, such as about 10 minutes for an edit and about 5 minutes for a change, are estimates, not guarantees; some requests take longer. We may set limits on use, such as file sizes, video length or the number of edits per day.

4. Your content

• You keep ownership of your Input, and of the Output we create for you, to the extent the law allows.
• You give us permission to use it to run cutz. You grant HireCreatives a worldwide, non-exclusive, royalty-free licence to host, copy, process, edit and transmit your Input and Output to provide, secure and improve the Services, as described in our Privacy Policy.
• You have the rights to what you send. You confirm that you own your Input or have all the permissions needed to use it, including permission from the people who appear in it, and that our use of it under these terms will not break the law or anyone's rights.

5. Acceptable use

You may not use cutz to create, edit or share content that:

• is illegal, or infringes anyone's copyright, trademark, privacy or other rights;
• sexually exploits or endangers minors, or is sexual content involving anyone without their consent;
• impersonates a person, or presents a real person as saying or doing something they did not (a deepfake) to deceive, defame or harm;
• harasses, threatens, or promotes violence or hatred against people;
• is spam, a scam, or misleading in a way that could cause harm.

You also may not try to break, overload or get around the security or limits of the Services; reverse engineer them; access them with bots or scripts except as we allow; try to get cutz to reveal its instructions or other customers' data; or use the Services to build a competing product.

6. AI output

cutz uses AI, and its Output can contain mistakes, such as wrong captions, cuts or spellings. Review every edit before you publish or rely on it. You are responsible for how you use the Output.

7. Fees

cutz is currently free to use. We may introduce paid plans in the future; we will tell you before you are charged anything, and paid features may come with additional terms.

8. Messages from cutz

By messaging cutz, you agree to receive WhatsApp messages from us, including replies, edited videos, links and service updates, which may be sent automatically. Reply “STOP” at any time to stop receiving messages. Your mobile carrier's message and data rates may apply.

9. Third-party services

cutz works through WhatsApp and relies on other third-party services. Your use of WhatsApp is governed by WhatsApp's own terms. cutz is not affiliated with or endorsed by WhatsApp or Meta. We are not responsible for third-party services, content or websites.

10. Our rights

HireCreatives owns the Services, including the software, the cutz name and logo, and the editing techniques and templates we use. These terms do not give you any right to them except to use the Services as allowed here. If you send us feedback or ideas, we may use them without any obligation to you.

11. Changes, suspension and ending

We may change, add or remove features of the Services at any time. We may suspend or end your access if you break these terms, if your use creates risk or legal exposure for us or others, or if we stop offering the Services. You can stop using cutz at any time and ask us to delete your data (see Delete your data).

12. Disclaimers

The Services and all Output are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted, error-free or always available, or that any Output will be accurate or suitable for your purpose.

13. Limitation of liability

To the fullest extent the law allows, HireCreatives will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total liability for all claims relating to the Services is limited to the greater of USD 100 or the amount you paid us for the Services in the six months before the claim.

Some places do not allow these limits, so some of them may not apply to you.

14. Indemnity

You agree to cover HireCreatives' losses and costs, including reasonable legal fees, from any claim arising from your Input, your use of the Services or your breach of these terms.

15. Changes to these terms

We may update these terms. When we do, we change the “Last updated” date above, and if a change is material we will tell you where reasonably possible. If you keep using the Services after a change takes effect, you accept the updated terms.

16. General

These terms are governed by the laws of the country where HireCreatives is registered, and disputes will be handled by the courts there, unless the law where you live requires otherwise. If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these terms, that is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a business transfer. These terms are the entire agreement between you and us about the Services.
